Agreement to Terms
By accessing or using the Cognitive Systems platform and services ("Services") provided by General Systems, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use our Services.
These Terms apply to all visitors, users, and others who access or use our Services.
Description of Services
Cognitive Systems provides industrial AI platforms including:
→ **COGNITION ENGINE**: Predictive maintenance and anomaly detection
→ **VISION CORTEX**: AI-powered visual inspection and quality control
→ **TWIN FORGE**: Digital twin simulation and optimization
→ **EDGE FORGE**: Edge AI deployment and management
→ **SHIN Voice AI**: Multilingual voice assistant
Services may include software, APIs, documentation, support, and related offerings.
User Accounts
To access certain features, you must create an account. You agree to:
→ Provide accurate and complete registration information
→ Maintain the security of your account credentials
→ Promptly notify us of any unauthorized use
→ Accept responsibility for all activities under your account
We reserve the right to suspend or terminate accounts that violate these Terms.
Acceptable Use
You agree not to:
→ Use the Services for any unlawful purpose
→ Attempt to gain unauthorized access to our systems
→ Interfere with or disrupt the Services
→ Reverse engineer or decompile any software
→ Use the Services to transmit malware or harmful code
→ Violate any applicable laws or regulations
→ Infringe on intellectual property rights
We reserve the right to investigate and take appropriate action against violations.
Intellectual Property
The Services and all content, features, and functionality are owned by General Systems and are protected by copyright, trademark, and other intellectual property laws.
Your Content: You retain ownership of data you upload. By uploading content, you grant us a license to use it solely for providing the Services.
Our Technology: Our AI models, algorithms, software, and platforms remain our exclusive property.
Payment Terms
For paid Services:
→ Fees are specified in your service agreement or order form
→ All fees are in the currency specified and exclude applicable taxes
→ Payment is due according to the agreed payment schedule
→ Late payments may incur interest at 1.5% per month
→ We may suspend Services for non-payment after notice
Refunds are handled according to our refund policy and service agreement.
Service Level Agreement
We commit to:
→ 99.9% uptime for cloud-hosted Services (excluding scheduled maintenance)
→ Response times as specified in your support plan
→ Regular security updates and patches
→ Data backup and disaster recovery measures
Specific SLA terms are detailed in your service agreement.
Data Processing
We process your data in accordance with our Privacy Policy and applicable data protection laws. For customers requiring specific data processing terms, we offer Data Processing Agreements (DPAs) compliant with GDPR and other regulations.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
→ Our total liability shall not exceed the fees paid in the 12 months preceding the claim
→ We are not liable for indirect, incidental, special, or consequential damages
→ We are not liable for loss of data, profits, or business opportunities
→ These limitations apply regardless of the form of action
Some jurisdictions do not allow certain limitations, so these may not apply to you.
Indemnification
You agree to indemnify and hold harmless General Systems, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from:
→ Your use of the Services
→ Your violation of these Terms
→ Your violation of any third-party rights
→ Your content or data uploaded to the Services
Termination
Either party may terminate:
→ For convenience with 30 days written notice
→ Immediately for material breach not cured within 15 days of notice
→ Immediately if the other party becomes insolvent
Upon termination:
→ Your right to use the Services ends immediately
→ You may request export of your data within 30 days
→ Outstanding fees become immediately due
→ Provisions that should survive termination will remain in effect
Governing Law
These Terms are governed by the laws of India. Any disputes shall be resolved in the courts of Nashik, Maharashtra, India. Notwithstanding this, we may seek injunctive relief in any jurisdiction.
Changes to Terms
We may modify these Terms at any time. We will notify you of material changes via email or through the Services. Continued use after changes constitutes acceptance of the new Terms.
